Privacy Statement

We, vPromos, Inc., a Texas corporation (vPromos,” “we” or “us”), explain in this Statement what information we receive and collect from and about you if you enroll or participate in any of our vLoyalty programs, including on merchant vLoyalty Facebook pages. This Statement does not cover any other information that we collect, including, without limitation, data that we collect offline, or data that unaffiliated merchants may collect from you in connection with purchases that may qualify under a vLoyalty program.

vLoyalty programs are merchant specific.

We operate and administer separate vLoyalty programs for merchants. You can sign up at a merchant for such merchant’s specific vLoyalty program after you complete a purchase or go the merchant’s vLoyalty Facebook page to sign up. We do not share information of what you buy at one merchant with any other merchant. We use transaction information only to administer vLoyalty programs and for statistical analysis purposes. Check with each merchant on its own data collection and processing basis. We do not control a merchant’s data policy.

Participation is voluntary.

You participate voluntarily in the vLoyalty program. Neither vPromos nor any merchant may or does require you to join any vLoyalty program or to provide any data to register for vLoyalty as a condition to payment with a credit or debit card (“Payment Card”) or to making purchases.

Information We Collect.

Information you actively provide: When you register for a vLoyalty program, we may ask you to provide or grant permission to collect your first and last name, cell phone number, Payment Card number, email address, postal address, zip code and other information. If you agree to enroll and participate in the merchant’s vLoyalty Program or link your merchant vLoyalty program with the merchant’s Facebook page, you will actively provide such information and you will know what information you provide.

Information you automatically provide: When you pay with a Payment Card that you registered for a merchant’s vLoyalty program at such merchant, we may automatically receive your first and last name and Payment Card number, or a token thereof, and transaction information from the merchant and/or Credit Card Company. We use this information to manage the merchant’s vLoyalty Program.

Tracking your vLoyalty status. If you registered for and participate in a merchant’s vLoyalty program, you may keep up with your status at the merchant’s vLoyalty Facebook page.  This is optional.  You do not have to link your vLoyalty account on the merchant’s vLoyalty Facebook page to participate in the merchant’s vLoyalty Program.  You may keep up with your status of the points earned and redeemed by you with such merchant by texting “status” to 26173. If you do link your vLoyalty account with the merchant’s vLoyalty Facebook page, vPromos will collect certain information as described below.

Information we or Facebook collect from you on our Facebook page:  If you decide to link your merchant vLoyalty program with the merchant’s vLoyalty Facebook page, or initiate enrollment in the merchant’s Programat the merchant’s vLoyaltyFacebook page, we collect the following information from you, some of which we collect automatically (including, without limitation, through any Facebook-provided technology) and other we ask to you provide for signing up: an identifier (selected and provided by you), your first and last names, your birthday, your e-mail address, your gender, the age range applicable for your age, and your geographic location.  In addition to our use of such information as described below, we may disclose such information to Facebook as required under Facebook’s data policy and other policies, as modified from time to time. 

When signing up with us or visiting us on our Facebook page, Facebook may also collect data from you.  Facebook, and any third parties may also use cookies, web beacons, and other storage technologies to collect or receive information from you to use such information to provide measurement services, target ads.  All such collection and use is subject to Facebook’s data policy, as in effect at any given time.  You agree that we are not liable, and that you have no claims, rights, remedies, or recourse against us, with regard to any data collected by Facebook and Facebook’s use of any of your data or any breach of Facebook’s data policy and other policies.

We will delete the data that we collect from you through our Facebook page if we receive an express written request at the e-mail address set forth below; such a request should have the subject line: “Request to Delete Data Collected on Facebook” and give your full name, birthday, and e-mail address.  Even with such a request, we may retain any aggregated data if your identity cannot be reasonably inferred or derived from such aggregated data, or we are obligated to maintain such data by law, order of any court or government agency, or an agreement with Facebook.

Use of Information.

We use your information to administer and improve vLoyalty programs and accounts, to send you promotional information about our or the merchants’ products, or to aid us in serving you better; and protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

Sharing of Information.

We do not rent, sell or otherwise share your individual, personal information with third parties, except as follows, and you consent to our sharing or providing your information in accordance with the following:

  • We share information regarding a particular merchant-specific vLoyalty account with the merchant for whose vLoyalty program you have registered so the merchant can provide and redeem awards; some merchants configure their accounts so they cannot see some or any personal information on an individual, named user basis.
  • We provide information to Facebook in connection with our relationship with Facebook if we deem it reasonable.
  • With your consent.
  • We use affiliated and unaffiliated service providers all over the world that help us deliver our service and run our business subject to confidentiality agreements.
  •  We share aggregated usage statistics that cannot be used to identify you individually.
  • We may share your personal information for the purposes of a business deal (or negotiation of a business deal) involving sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.
  • We may disclose your personal information to

a.     comply with relevant laws, regulatory requirements and to respond to lawful requests, court orders, and legal process;

b.     to protect and defend the rights or property of us or third parties, including enforcing agreements, policies, and terms of use;

c.     in an emergency, including to protect the safety of our employees or any person;

d.     or in connection with investigating and preventing fraud.

Choices about Your Information.

You can opt-out of promotional emails and text messages from us by following the unsubscribe instructions provided in e-mails and text messages you receive or by contacting us directly (please see contact information below). If you opt-out, we may still send you non-marketing e-mails including e-mails about your accounts and our business dealings with you. Unless you opt out, you may receive offers and alerts resulting from your purchasing activity and confirmation text messages for each vLoyalty earned.

To opt out of the text messages features of our programs, send a text message with the word "STOP" to 26173 from the mobile phone number associated with your vLoyalty Program account. Once you opt out, you will not receive any additional text messages unless you re-register on the Website or via your phone. Should you need help, just text HELP to 26173.

Security of Your Information.

We apply organizational and technical measures to ensure access to your information is limited to persons with a need to know. Even though we have taken steps to protect your personal information, you should know that neither we nor any company can fully eliminate security risks.

We are headquartered in Texas, United States. We host our servers and process information in the United States.

We may update this Statement from time to time. When we do, we will change the last updated date above to let you know we made a change.
